These Terms of Service ("Terms") are a binding agreement between you and Arship LLC ("Arship," "we," "our," or "us"). They govern your use of the Arship mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.
Please read sections 6 (User-Generated Content), 7 (Music Copyright & Licensing), 14 (Disclaimers), and 15 (Limitation of Liability) carefully. They limit our liability and set out important obligations for you. If you don't agree to any part of these Terms, don't use the Service.
You must be at least 18 years old to create an account or use the Service. We ask for your date of birth when you sign up, or, for older accounts, when you accept updated Terms. Accounts for minors are not available, including accounts created by a parent. If you have not reached the age of majority where you live (for example, where it is higher than 18), you may use the Service only if your parent or guardian agrees to these Terms on your behalf. If we learn that someone under 18 has an account, we will close it and delete its personal information.
The Service is currently offered in the United States. You agree to give accurate information when you register, including your date of birth, and to keep it up to date. You may not create an account for anyone else.
Arship is a private collaboration tool for worship teams, bands, and similar music groups. With the Service, you can:
Arship is for private team use only. Recordings, messages, and other content are visible only to current members of the team (or the direct-message conversation) where you share them. Arship is not a publishing, broadcasting, or commercial distribution service. We may change, add, or remove features over time.
You are responsible for keeping your sign-in credentials safe and for activity on your account. Tell us right away at support@arship.app if you suspect someone has accessed your account without permission.
You may not share, sell, or transfer your account, or create extra accounts to get around a block, suspension, or these Terms.
Team owners and admins can invite and remove members, change roles, schedule services, approve or delete recordings, delete content in their team, and see team-level information described in our Privacy Policy, including reports filed in the team. If you create a team, you are responsible for using these tools fairly and for having permission to invite the people you add.
Our Privacy Policy explains how we handle your information, including what happens to your content when you leave a team or delete your account. It is part of these Terms.
The Service is currently free. If we introduce paid features, we will show you the price, billing frequency, renewal and cancellation terms, and any trial terms before you buy. We will not charge you without your express agreement.
"User Content" means anything you create, upload, post, send, or display through the Service, including voice recordings, photos, music sheets, messages, song requests, lyrics, song lists, availability notes, and other materials.
You keep all ownership rights in your User Content. We do not claim ownership of your recordings or other contributions.
When you submit User Content, you grant Arship a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, and play it, only to operate and provide the Service to you and the people you share it with, and to keep the Service safe (for example, reviewing reported content). You can let our service providers exercise this license for those purposes. The license ends when the User Content is deleted from our active systems, except for (a) backup copies kept under our normal retention, (b) content that stays with your team as described in Section 6.6, and (c) where we must keep it by law or for safety reasons.
You also grant current members of the team (or conversation) where you share User Content a license to view and listen to it so they can take part in that team's activity.
You promise that:
We do not tolerate objectionable content or abusive users. Objectionable content includes content that is sexually explicit, exploits or endangers minors, harasses or threatens, is hateful, or otherwise breaks our Acceptable Use Policy. We do not pre-screen User Content, but we may review, restrict, or remove any User Content, and suspend or terminate any account, that we believe breaks these Terms, the Acceptable Use Policy, or the law.
If you leave a team, what you shared there stays with the team. If you delete your account, we delete your profile and most of your content, but chat messages you sent stay in the conversation, anonymized as from "Deleted user", with their text intact. Songs and setlists you created stay with the team. Our Privacy Policy lists exactly what is deleted and what is kept.
Most worship songs and other musical works are protected by copyright. Two separate rights are usually involved when you record yourself performing a song:
You are solely responsible for getting any licenses, permissions, or consents needed to record, copy, share, or perform copyrighted music through the Service. Depending on your situation, these may include:
If you're not sure you or your team has the right to use a song through Arship, don't upload it until you've confirmed. See our Copyright FAQ for plain-language guidance.
Arship does not license musical works to you and does not promise that any use is authorized. "Your team's song library" means the records your team keeps in Arship. It does not transfer any copyright to you or your team.
You may not use the Service to publish, broadcast, stream, monetize, sell, or otherwise commercially exploit recordings of copyrighted musical works. The Service is for private team rehearsal and review only.
Do not upload commercial sound recordings (for example, purchased or streamed tracks or CD rips), or multitrack stems, click tracks, guide tracks, or backing tracks licensed to a specific church or organization (including content from MultiTracks, Loop Community, or similar services), unless the rights holder has given you express written permission.
Arship complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on the Service infringes your copyright, send a notice as described in our DMCA Policy. A counter-notification procedure is also available.
Repeat infringers. Where appropriate, we terminate the accounts of repeat infringers. Three valid DMCA takedown notices against the same account will, absent extenuating circumstances, result in termination.
Your use of the Service is subject to our Acceptable Use Policy, which is part of these Terms.
The Service relies on third-party providers, including Google Firebase and Google Cloud, Apple (Sign in with Apple, push notifications, App Attest), Google Sign-In, and Resend for system email. Using those features may also be subject to those providers' terms. We are not responsible for third-party services we don't control.
If you send us suggestions or feedback about the Service, including song or feature requests, you grant us a perpetual, royalty-free license to use it to improve Arship, with no obligation to you.
You can delete your account at any time in Settings → Delete Account. If you own a team, you need to transfer ownership or delete the team first. Deletion is permanent and follows Section 6.6 and our Privacy Policy.
We may suspend or terminate your account, or remove content, with or without notice, if you break these Terms, the Acceptable Use Policy, or the DMCA repeat-infringer policy; if the law requires it; or if your account puts Arship or other users at risk. If you think we made a mistake, email support@arship.app and we will review it.
Sections 6.2 (to the extent content is kept as described), 6.6, 7, 13, 14, 15, 16, 17, and 18 survive termination.
We may update these Terms from time to time. If we make a material change, we will give you reasonable notice, for example in the App or by email, and update the "Last updated" date above. The App will ask you to accept the new Terms on an "Updated Terms" screen. If you decline, you will be signed out. If you keep using the Service after the change takes effect, you accept the updated Terms. If you don't agree, stop using the Service and delete your account.
The Service is provided "as is" and "as available," without warranty of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
Without limiting the above, we do not promise that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that any content will be preserved, recoverable, or accurate. Recordings and other User Content can be lost through user error, device problems, or service failures, so keep your own copies of anything important.
To the maximum extent permitted by law, in no event will Arship LLC, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for lost profits, lost revenue, lost data, business interruption, or any other commercial damages or losses, arising out of or related to these Terms or the Service, regardless of the theory of liability and regardless of whether Arship has been advised of the possibility of such damages.
Arship's total cumulative liability arising from or related to these Terms or the Service is limited to the greater of (a) the amount you have paid Arship in the twelve months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of incidental or consequential damages. In those jurisdictions, the limits above may not apply to you, and our liability is limited to the greatest extent the law allows.
To the extent the law allows, you agree to indemnify, defend, and hold harmless Arship LLC, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, and fees (including reasonable attorneys' fees) arising out of or related to:
We may take over the defense of any matter you must indemnify us for, and if we do, you agree to cooperate.
These Terms, and any dispute arising out of or related to them or the Service, are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws rules.
Any legal action or proceeding arising out of or related to these Terms or the Service will be brought only in the state or federal courts located in Michigan, and you consent to the personal jurisdiction and venue of those courts.
To the extent the law allows, any claim you have against Arship must be brought within one (1) year after it arises, or it is permanently barred.
Entire agreement. These Terms, together with the Privacy Policy, Acceptable Use Policy, DMCA Policy, and any in-app notices we provide, are the entire agreement between you and Arship on this subject and replace any earlier agreements.
Severability. If any provision of these Terms is held invalid or unenforceable, the rest stay in full effect.
No waiver. If we don't enforce a right or provision, that doesn't waive it.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign them as part of a merger, acquisition, or sale of assets.
Third-party beneficiaries. Except for Apple and its subsidiaries as described below, these Terms create no third-party beneficiary rights.
Export controls and sanctions. You may not use the Service in violation of U.S. export-control or sanctions laws, or if you are a person or in a place those laws prohibit us from serving.
If you downloaded the App from the Apple App Store:
Google Play. If you downloaded the App from Google Play, these Terms are between you and Arship only, and Google is not responsible for the App.
